1. Agreement
By using the Travelers Incorporated website ("Site"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Site. "Company," "we," "us," or "our" refers to Travelers Incorporated. We may update these Terms at any time; continued use constitutes acceptance.
2. What We Do
Travelers Incorporated is a marketplace connecting vacationers ("Renters") with timeshare owners ("Owners") who wish to rent their unused resort weeks. We facilitate the listing, booking, and payment process. We are not the property owner, a hotel, a resort operator, a travel agency, or a real estate broker. The rental arrangement is between the Renter and the Owner, with Travelers Incorporated acting as the facilitating platform.
3. Renter Terms โ Pricing and Fees
Renters pay the full listed rental price plus a 5% processing fee at the time of booking. The processing fee is non-negotiable and covers booking facilitation, payment processing, and platform costs. All prices are in US dollars. Prices do not include airfare, ground transportation, meals, activities, resort fees, travel insurance, or any other expenses unless explicitly stated in the listing.
4. Renter Terms โ No Refunds
All bookings are final. No refunds are provided by default. Travelers Incorporated does not offer refunds, credits, or exchanges for any reason, including but not limited to: change of plans, scheduling conflicts, travel disruptions, dissatisfaction with the property, weather, illness, or failure to check in. Refunds are solely at the complete and sole discretion of the property Owner. If the Owner elects to issue a refund (in whole or in part), Travelers Incorporated will facilitate the refund minus the 5% processing fee, which is non-refundable in all circumstances. We strongly recommend purchasing comprehensive travel insurance to protect your booking.
5. Renter Terms โ Booking Confirmation
A booking is confirmed only after full payment is successfully processed. You will receive a confirmation email with booking details, check-in instructions, and resort information. It is your responsibility to review this information and contact us immediately with any questions or concerns.
6. Owner Terms โ Free Listing
Owners may list their timeshare weeks on the Site at no upfront cost. There are no listing fees, subscription fees, or setup fees. All listings are subject to review and approval by Travelers Incorporated. We reserve the right to reject, modify, remove, or suspend any listing at our sole discretion and without notice.
7. Owner Terms โ Commission on Successful Rental
When an Owner's listing successfully rents, Travelers Incorporated collects a commission of $400 or 10% of the rental price, whichever is lower. This commission is deducted from the rental proceeds before the Owner's payout. The Owner receives the rental price minus the commission. The commission is non-refundable once collected, even if the Owner later issues a discretionary refund to the Renter. Commission amounts are calculated at the time of booking and are final.
8. Owner Terms โ Obligations
By listing on the Site, Owners agree to: provide truthful and accurate property information and availability; honor all confirmed bookings at the listed price; maintain their property in the condition represented; promptly disclose any material changes (renovation, damage, availability changes) to Travelers Incorporated; and cooperate with the resort's check-in process to ensure the Renter's smooth arrival. Failure to honor a confirmed booking may result in suspension or removal from the platform.
9. Timeshare Rental Disclosures
All properties listed on this Site are privately owned timeshare weeks being rented by their individual owners. Travelers Incorporated does not own, operate, or manage any resort property. Resort amenities, check-in procedures, property conditions, and unit assignments are governed by the resort operator, not by Travelers Incorporated. Photographs and descriptions are representative of the unit type and may not depict the exact unit assigned. The specific unit is assigned by the resort at check-in.
10. Payment Processing
All payments are processed through Stripe, Inc., a PCI DSS Level 1 compliant payment processor. Travelers Incorporated does not store, access, or retain credit card numbers, CVVs, or sensitive payment credentials on our servers. By submitting payment, you authorize the charge of the full rental price plus processing fee as a single transaction. All amounts are in US dollars. You are responsible for any currency conversion or international transaction fees charged by your bank or card issuer.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRAVELERS INCORPORATED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR ANY BOOKING. Our total liability for any claim shall not exceed the processing fee you paid for the specific reservation in question. We are not liable for the actions, omissions, or conduct of any property Owner, resort operator, or third party.
12. Disclaimer of Warranties
The Site and all content are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that any listing, photograph, description, or information on the Site is accurate, complete, or current.
13. Indemnification
You agree to indemnify, defend, and hold harmless Travelers Incorporated, its officers, directors, employees, and agents from all claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising from: your use of the Site; your violation of these Terms; your violation of any third-party rights; or any dispute between a Renter and an Owner.
14. Guest Responsibilities
Renters are responsible for complying with all resort rules and regulations, treating the property with reasonable care, reporting damages promptly, not exceeding maximum occupancy, and complying with all applicable laws during their stay. Any damages, fines, or charges incurred at the resort are the sole responsibility of the Renter.
15. Age Requirement
You must be at least 18 years old to use this Site and make bookings. The primary guest checking in must meet the resort's minimum age requirement (typically 21 or 25 years, depending on the property). Failure to meet age requirements at check-in is not grounds for a refund.
16. Intellectual Property
All content on this Site, including text, graphics, logos, photographs, and software, is the property of Travelers Incorporated or its licensors and is protected by US and international copyright laws. Reproduction, distribution, or modification without prior written consent is prohibited.
17. Privacy
Your use of the Site is governed by our Privacy Policy, incorporated here by reference. We collect only information necessary to process bookings and communicate with you. We do not sell personal information to third parties.
18. Force Majeure
Neither party is liable for failure to perform due to causes beyond reasonable control, including natural disasters, pandemics, government actions, war, terrorism, or utility failures. In such events, Travelers Incorporated will make reasonable efforts to work with the Owner toward a resolution, but refunds are not guaranteed under force majeure circumstances.
19. Governing Law and Disputes
These Terms are governed by the laws of the State of Washington. Any dispute arising from these Terms or your use of the Site shall be resolved through binding arbitration in King County, Washington, under the rules of the American Arbitration Association. You waive any right to participate in class action litigation or class-wide arbitration. The prevailing party is entitled to recover reasonable attorney's fees.
20. Severability and Entire Agreement
If any provision of these Terms is unenforceable, the remaining provisions remain in full force. These Terms, together with our Privacy Policy and Cancellation Policy, constitute the entire agreement between you and Travelers Incorporated. Prior agreements or representations are superseded.
